Terms and Conditions: MYOB Woman Entrepreneur of the Year Awards 2019

1. Definitions

Applicant: Refers to any person entering or attempting to enter the Competition. 

Competition: Refers to the competition offered and administrated by Mahuki for the return trip for one adult from Auckland, New Zealand to Paris, France. 

Competition Period: Refers to the entry period for the Competition, which starts at 09:00am on 11.01.19 and closes at 5.00pm on 15.02.19.

Competition Sponsors: Refers to the names of any parties involved in supporting or promoting the Competition.

Employed: Refers to any person past or present who is/was contracted or employed by Te Papa, Mahuki or a Competition Sponsor in any capacity, including part-time, casual and contract roles. 

Finalist: Refers to the four shortlisted Applicants who will compete in the New Zealand event for the Woman Entrepreneur of the Year Awards.

INCO: Refers to INCO, a non-profit organisation, at 3 Boulevard Saint-martin, Paris, Ile de France 75003, FR

Mahuki: Refers to Mahuki Tahi Limited at 55 Cable Street, Wellington, New Zealand.

MYOB: Refers to MYOB NZ Limited at Level 7, 36 Brandon Street, Wellington, 6011, New Zealand

MYOB Woman Entrepreneur of the Year Award:  Refers to the New Zealand segment of the international award competition for the Woman Entrepreneur of the Year Awards

Prize:  Refers to the contents specified as the "Prize" in the "Prize Details" section below.

Te Papa: Refers to the Museum of New Zealand Te Papa Tongarewa, an Autonomous Crown Entity, at 55 Cable Street, Te Aro, Wellington, New Zealand.

Terms and Conditions: The terms and conditions as outlined in this document.

Woman Entrepreneur of the Year Awards: Refers to the international award competition hosted by INCO

2. Prize Details

2.1 The "Prize" consists of the following:

a) Flights for one adult from Auckland to Paris (via Los Angeles) return, economy class on Air New Zealand on 26.03.19 - 29.03.19

b) Accommodation for one adult 26.03.19 - 29.03.19 at Hotel du Vieux Marais in a Single Room (1 twin bed)

c) Admission to Impact² World Forum Conference, to be held at the same location as the Woman Entrepreneur of the Year Awards

2.2 The Prize must be taken as a package by the Competition winner and at the times set out above as determined by Mahuki and/or the Competition Sponsors. 

2.3 No aspects of the Prize are changeable, transferable, re-routable, and redeemable for cash or subject to name changes. Mahuki reserves the right to replace any aspect of the prize with another prize of equal or greater value if the Prize becomes unavailable for any reason outside of Mahuki's reasonable control.

2.4 Aspects of the Prize, such as flights and accommodation may be subject to availability, as well as additional terms and conditions imposed by third parties. The winner agrees to comply with all such third party terms and conditions. 

2.5 All other incidentals and costs related to the Prize that are not explicitly stated in the Prize Details above such as meals, transportation (including any transfer to and from Auckland), surcharges and airport taxes (including fuel surcharges), insurance, laundry, minibar, visas, passports and associated taxes, are to be borne by the winner. No mileage accrual is available for the flights in the Prize.

3. How to Enter and Terms of Entry

3.1 Applicants may enter the Competition during the Competition Period online via the Mahuki website.

3.2 Any applications received outside the Competition Period will not be accepted.

3.3 By entering the Competition, the Applicant fully and unconditionally agrees and acknowledges these Terms and Conditions and any other terms notified to the Applicant at the time of entry. 

3.4 Applications are limited to one per person and must include the Applicant's full name, phone number and email address. Incomplete applications will be void and will not be included in the shortlisting. 

3.5 Applicants must be over the age of 18 to participate.

3.6 Applications must hold an appropriate passport, valid for at least 6 months before expiry from the dates of travel for the Prize. Applicants must also be eligible to meet any visa requirements necessary to redeem the Prize.

3.7 Applicants must be available and willing to travel to Paris on the travel dates as set out in the Prize Details above and be able to get to Auckland departure destination before the flight from Auckland to Paris.

3.8 The Competition is only open to those applications that meet these Terms and Conditions. Non valid applications will be voided. If the Competition winner does not meet all the Terms and Conditions at the time of shortlisting, they will be prohibited from claiming the Prize.

3.9 Mahuki reserves the right to request proof of an Applicant's eligibility in the event there is doubt over her eligibility for the Prize draw.

3.10 In the event of a dispute of the identity of the Applicant, the Applicant will be deemed to be the individual who is the registered owner of the phone number provided at the time of application. 

3.11 Applicant must be available and willing to compete at the MYOB Woman Entrepreneur of the Year Award on 04.03.19 at The National Museum of New Zealand Te Papa Tongarewa

4. The Prize Draw and Determining the Winner

4.1 On 19.02.19 (or as soon as possible thereafter), a panel of judges elected by Mahuki and Competition Sponsors, will shortlist the applications to find the Finalists to compete in the MYOB Woman Entrepreneur of the Year Awards.

4.2 Mahuki will take reasonable steps to contact the Finalists after shortlisting however is: (i) despite reasonable efforts to do so, the person cannot be contacted within two working days from the first attempt to contact; (ii) that person is unable to accept the Prize for any reason: and/or (iii) the person does not meet the Terms and Conditions set out herein meaning she is not eligible; then, that person will not be the winner of the Prize and Mahuki will have the right offer the Prize to another applicant. 

4.3 Once a person is selected, contacted, deemed eligible and accepts the Prize in accordance with these Terms and Conditions, the person will then be deemed the "Winner" of the Competition. 

4.4 If the Winner finds she cannot use the Prize for any reason (e.g. due to failure to obtain a visa), the Winner will notify Mahuki as soon as possible and Mahuki may elect to withdraw the Prize or offer the Prize to another applicant. 

5. Promotion

5.1 By accepting the Prize, the Winner agrees to make themselves available for promotional and publicity purpose on reasonable notice from Mahuki.

5.2 The Winner also agrees to provide an appropriate image of themselves to be used in the winning announcement by Mahuki and the Competition Sponsors. Additional images for promotion may be negotiated between Mahuki and the Winner. 

5.3 Mahuki and the Competition Sponsors may use the winner's name and photographs for promotional and media purposes without compensation and all intellectual property rights including copyright in any such material will belong to Mahuki and Te Papa.

6. Privacy

6.1 Any personal information collected as part of the Competition and the submitted applications will be collected, kept and used in accordance with these Terms and Conditions and the Privacy Act 1993.

6.2 Mahuki and the Competition Sponsors may collect and use personal information about you for the purpose of administering the Competition including contacting winners, verifying the eligibility and validity of an applicant and marketing the goods and services of Mahuki and Competition Sponsors. If an Applicant does not enter valid, accurate or complete information when requested by Mahuki (including as part of the application), the Applicant may be disqualified from applying into the Competition as certain information is required to administer the Competition. You may access or correct information stored about them by contacting Mahuki at 55 Cable Street, Te Aro, Wellington or priscilla.loong@tepapa.govt.nz. You can also contact Mahuki if they do not wish to be contacted by Mahuki for marketing purposes. 

7. Liability

7.1 Mahuki is not responsible for any incorrect or inaccurate entries completed by Applicants, lost applications interrupted or unviable network, server or other connections, scrambled transmission or other errors or problem of any kind whether mechanical, human, electronic, technical malfunctions of the computer hardware, software or any combination thereof; or problems associated with any virus or any other damage caused to the Applicants systems. 

7.2 If the website is out of order, Mahuki reserves the right to offer replacement application mechanisms at its discretion.

7.3 Mahuki and the Competition Sponsors (including their associated entities, employees or agents), will not be liable for any cost, expense, loss, damage or injury suffered by or to a person whatsoever (including but not limited to: direct, indirect, consequential loss or loss arising from negligence) arising directly, indirectly or in connection with the Competition or the Prize, except for any liability that cannot be excluded by law. For avoidance of doubt, Te Papa is not liable for any tax implications that may result of winning.

8. General

8.1 Mahuki's decisions on all matters regarding the Competition are final and no correspondence will be entered into. 

8.2 Mahuki may change the Terms and Conditions at any time, and if the Competition cannot be reasonably run for any reason, Mahuki reserves the right to cancel, modify or suspend the Competition at any time, and Mahuki shall not be liable to any Applicant or Prize winner for any loss or damage incurred as a result. 

8.3 By applying to the Competition, the Applicant agrees that Mahuki has not made any representations as to the quality or fitness for purpose of the Prize.

8.4 Mahuki's failure, or choice, not to enforce any aspect of the Terms and Conditions does not constitute a waiver of that or any other provision set out in the Terms and Conditions.

8.5 These Terms and Conditions are governed by New Zealand law and any dispute arising out of or in connection with them will be subject to the exclusive jurisdiction of the New Zealand courts.
